Terms of Service

By creating an account or using the Service, you agree to these Terms. Please read them carefully. If you do not agree, do not use the Service.
Account Requirement
An account is required to access EliteFlowJournal. This applies to Free tier users, Monthly subscribers, and Yearly subscribers. You must be at least 18 years old, provide accurate information, maintain credential confidentiality, and accept full responsibility for all activity under your account.
Description of Service
EliteFlowJournal is a trading journal and analytics software platform that enables users to record, review, and analyze trading activity. We offer a Free Tier with limited features and two paid subscription tiers. We reserve the right to modify or remove features at any time. For material changes to features included in a paid subscription tier, we will provide at least 14 days' advance notice by email to your registered address. If a core paid feature is permanently removed without a comparable replacement, you may cancel before the change takes effect and receive a prorated refund for the unused portion of your current billing period.
Subscriptions & Billing
Paid subscriptions are billed on a recurring basis (monthly or yearly). By subscribing, you authorize automatic recurring charges to your payment method on file. 14-Day Refund Window for New Subscribers: If you are a new subscriber and have not actively used the Service, you may request a full refund within 14 days of your initial subscription purchase. To request a refund, contact us at support.eliteflow@gmail.com. By actively using the Service (e.g., importing trades, creating journal entries) before 14 days have elapsed, you acknowledge that the Service has commenced and you waive this refund right. After the 14-day window, or once the Service has been actively used, all payments are final. No refunds will be provided for partial billing periods, unused time, or account termination due to violations of these Terms. Payments are processed by PayPal. EliteFlowJournal does not store your payment card information. By subscribing, you also agree to PayPal's terms of service.
Cancellation
You may cancel your subscription at any time through your account settings. Access remains active until the end of the current billing period. No prorated refunds will be issued for cancellations after the 14-day window described in Section 03. If we raise subscription prices, we will give you at least 30 days' advance notice by email. You may cancel before the new price takes effect without penalty.
Financial Disclaimer & Risk
EliteFlowJournal is strictly a journaling and analytics tool. We do NOT provide financial advice, offer recommendations, or act as a broker. Trading financial markets involves substantial risk. You may lose part or all of your capital. All trading decisions are solely your responsibility.
Data Loss Disclaimer
We implement industry-standard technical and organizational measures to protect your data. However, we cannot guarantee that data will always be available or uncorrupted. Data loss may occur due to server failures, software bugs, or cybersecurity incidents beyond our control. We strongly encourage you to regularly export your data using the export feature available in your account settings. Nothing in this Section limits our obligations under applicable data protection law or our liability for losses caused by our gross negligence.
No Warranties
The Service is provided 'AS IS' and 'AS AVAILABLE.' We disclaim all warranties, including accuracy of data, availability, or fitness for a particular purpose. We do not warrant that the Service will be error-free or secure. Nothing in this Section excludes any warranty that cannot be lawfully excluded under applicable mandatory law.
Limitation of Liability
To the fullest extent permitted by applicable law, EliteFlowJournal and its owners shall NOT be liable for trading losses, loss of capital, or loss of profit arising from your use of the Service. Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the greater of: (a) the total subscription fees paid by you in the 12 months preceding the claim, or (b) EUR 100. This limitation does not apply to liability arising from: (i) our gross negligence or willful misconduct; (ii) fraud or fraudulent misrepresentation; (iii) death or personal injury caused by our negligence; or (iv) any liability that cannot be excluded or limited under applicable mandatory law.
Acceptable Use
You agree not to reverse engineer the platform, attempt unauthorized access, share credentials, or upload malicious code. Violation may result in immediate termination without refund.
Beta Features
We may offer features labeled as Beta or Experimental. These may contain bugs or cause data loss. They are provided 'AS IS' and used entirely at your own risk.
Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including internet outages, hosting failures, cyberattacks, or acts of God. If a force majeure event causes a continuous service disruption lasting more than 30 days, you may cancel your subscription and receive a prorated refund for the unused period.
Termination
We may suspend or terminate your account at any time. If we terminate your account without cause, we will provide at least 14 days' notice and allow you to export your data before access is revoked. If your account is terminated due to a violation of these Terms, access will be revoked immediately. However, we will retain your data for 30 days following termination, during which you may contact us at support.eliteflow@gmail.com to request a data export. After this period, your data may be permanently deleted. You can export your data at any time during an active subscription through your account settings.
Indemnification
You agree to indemnify and hold harmless EliteFlowJournal from any third-party claims, damages, or losses arising directly from: (a) your violation of these Terms; (b) your violation of any applicable law in connection with your use of the Service; or (c) content you submit to the Service. This indemnification does not apply to claims arising from EliteFlowJournal's own negligence, fraud, or breach of these Terms.
Dispute Resolution
We'd prefer to resolve things directly. If you have a dispute, please contact us first at support.eliteflow@gmail.com and we will try to resolve it informally within 30 days. If informal resolution is not possible, the parties agree to attempt mediation before initiating formal proceedings. For consumers in the European Union, nothing in these Terms prevents you from bringing a claim in the courts of your country of domicile, as provided under applicable consumer protection law. The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. For disputes between EliteFlowJournal and business users (non-consumers), the parties agree to submit to the jurisdiction of the courts of Trieste, Italy.
Governing Law
These Terms are governed by the laws of Italy. For business users, disputes shall be subject to the exclusive jurisdiction of the courts of Trieste, Italy. For consumers, the governing law of Italy applies to the extent it does not deprive you of the protections afforded by the mandatory consumer protection laws of your country of residence.
Right to Modify Terms
We may update these Terms from time to time. For material changes, we will provide at least 14 days' advance notice by email to your registered address before the new Terms take effect. Non-material changes (such as typo corrections or clarifications that do not affect your rights) may take effect upon posting. If you do not agree with a material change, you may cancel your subscription before the effective date and receive a prorated refund for the unused portion of your billing period. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
Privacy & Data
Your use of the Service is governed by our Privacy Policy at https://eliteflowjournal.com/privacy. The Privacy Policy explains how we collect, use, and protect personal data, your rights under GDPR and other applicable laws, and how to submit data requests. EliteFlowJournal acts as the data controller for your account data. We use processors such as Supabase (hosting) and PayPal (payments). We do not store full card details. You own the content you create in the Service. By using the Service, you grant EliteFlowJournal a limited, non-exclusive license to store, process, and display your content solely to provide the Service. We will not sell your individual trading data to third parties.
Data Requests
You may request access, correction, export, or deletion of your personal data by contacting support.eliteflow@gmail.com. We may need to verify your identity before fulfilling requests. We aim to respond within 30 days unless a longer period is permitted by law.
